Service and Usage Agreement
Our services can be used for anything that is legal within the laws of Norway. Not all, but some of the usage we do not allow:
Should one of your services brake one of the conditions, your service can be terminated. ServerCity AS can, without warning ,choose to suspend or close your service when in suspicion of violation of the conditions mentioned above.
We offer a "7-day money return" guarantee if your service dont work as they should, and one of the scenarioes mentioned below is correct:
Billing and cancellation
Any service that has an unpaid invoice after 14 days of due date will automatically be terminated by midnight on day 15. This will lead to loss of all data on the terminated service. If you have any challenges regarding the invoice we ask you to make contact, so the due date can be prolonged.
All cancellation requests must be through your client area, and not directly on e-mail. Cancellation of a service will automatically give store credit if there are unused time left on the cancelled service subscription. The service will be removed from your client area after the invoice period subsides. Cancellations can be aborted any time by contacting our support team.
To reopen or restore a canceled service, that has been removed or deleted due to unpaid invoices, there will be a fee on 55$ - eks. tax.
By connecting your credit card, or your PayPal-account as a payment method, you allow us to charge unpaid invoices that are overdue.
All services are delivered with a preset amount of traffic amount. Services can be suspended if your usage exceeds your preset traffic amount. Additional traffic can be purchased at any time. Servers with an Unmetered traffic-plan must follow our policy for fair usage. The ports are shared with others (3:2:1) and a normal usage is expected. Your usage should not cause problems for other customers or our infrastructure. Constant usage for over 20% of the ports capacity will be viewed as overusage, and you can be asked to upgrade to a dedicated port without a "rush hour limit".
Ports with a "rush hour limit" will give you the full capacity of the port outside of what we define as rush hour. Incoming traffic will not be influenced. Rush hour is between 16:00 and 02:00 GMT+1. Dedicated ports without "rush hour limit" and can be used fully at all times.
If you dont have an excisting agreement, your overusage of traffic will be invoiced by 2.21USD per started TB on dedicated servers and virtual servers with a static trafficlimits, and 2.21USD per Mbit/s over the limit for IP-transit (calculated after the 95th precentile model). The prises regarding overusage is eks. tax.
ServerCity AS can only be held liable for errors due to gross negligence or intent. ServerCity AS is not liable for damages for losses due to reduced or lost production or turnover. A demand can not top the amount that ServerCity AS has invoiced the customer for the service ,in the current agreement period.
Loss of data and hardware warranty
ServerCity AS do not take backup of your services. You are responsible for backup of your data and the integrity of these. In cases of lost data ServerCity AS is no liable for damages. We recommend all our customers to keep sufficient backup at any time. Services where this applies, but not are limited to:
If a hardware component in a server breaks we will replace the defect component as soon as we can, or within 48 hours.
All your services take full use of our warranties.
Changes in our Service and Usage Agreement:
We reserve the right to change our Service and Usage Agreements. Changes will be reported through channels we deem as sufficient. If we make significant changes you will be notified by e-mail and/or on our website. All significant changes are binding 30 days after they were published on our website and/or e-mailed to you.
If the agreements execution wholly or partly is hindered, or is significantly hampered by circumstances beyond the control of the parties, the parties obligations will be suspended to the extent where the circumstances is relevant, and for as long time as the circumstances lasts. Circumstances like that includes, but does not limit to: strike, lockout, traffic defects at a third party, blackouts at a third party, and any circumstances that would be judged as a force majeure.

What data do we collect?
We collect information about you so we can provide you with the best experience when you use our services. Most of the data you give directly to us when you:
When we deliver you our services we might also collect other information about you, to make sure we deliver necessary and optimal usage of our service. Here is the information regarding what these are and how they function:
Information connected to your user account: when you use our services, by purchasing a service, when a service is renewed, customer support and requests, and notes that explain what you have asked for and how we replied to you.
Information about service usage: Will be collected automatically when you use and interact with our services, incl metadata, logging files, information cookies/unit and placement. This information includes specific data about your interaction with our services, content and links, IP-addresses, browser (with configurations and extensions), date when the service was used, language settings and information cookies, information regarding your unit (operating system, settings, applications IDs, ID on the unit and error messages. Some of this information can be used by us to give us your location.
Supplementing information might be collected from other sources, for instance public databases or bought through a third party. Such information can in some cases be combined with data we alreddy posess so we can update, expand and correct our data. It can also be used to identify new customers and offer more relevant products and services that might be of interest. If you provide personal information about others, or others give us your personal data, it will only be used for the purpose that are listed on the time we receive the information.
We beleave in minimizing the data we collect and limit the usage for the purpose it: 1) has been given permission to, 2) is nessecary to provide services and use it, or 3) we are obligated to collect, permission to after delivery, or other legal purposses. These include:

Often the information we collect is statistics data about how our services are used, and is not connected to personal data. In the cases where it is connected to personal data, or is linked/can be linked to a person, we will treat it appropriately.
Sharing with a trusted third party. We can share your personal data with connected companies within the same company group, with a third party we collaborate with to deliver our services, and with our suppliers when that is necessary for them to fulfill their services to us. For instance:
We only share the information that is necessary for the third party to fulfill their service. These third parties are subject to strict data processor agreements and the conditions hinders them from use, share or keep your personal data for other purposes than what they are hired to deliver (or without your consent).
Communicate with you.We can contact you directly or through a third party regarding products and services you have ordered or bought from us, in order to deliver transaction based or service related inquiries. We can also contact you with offers for more services that we think you will find interesting if you give your consent to this, or where it is permitted on legitimate interests. It is not mandatory to give us this consent in order to purchase our services. These inquiries can include email, text messages or phone conversations.
If we collect information in regards to a service that we resell from a third party, it will be shown clearly when we collect it. It will also give you choices on how you use or share your private data with a third party as far as it is possible.
If you use a service that allow you to create or import contacts (for instance: email accounts), we will only use the contact information that you have given when you ordered the service. If you suspect that someone has entered your personal information incorrectly or abused your personal information, and want it removed from our database, please contact us at email@example.com.
Cooperation with the police authority: We cooperate with the police authorities in accordance with the laws of Norway. We will provide information about you after we have received a court order from the competent authorities. If we have the opportunity, we will notify you of such extradition.
Targeted advertising: Targeted advertising or interest-based offers may be presented to you based on your activities on our websites or other sites, based on products you own/rent. These offers can be product banners that will be presented while you visit websites. We also use a third party to administer advertising on our and other websites. This third parties may use technologies like information kapsules to collect information about your activities to be able to give you advertising based on your visiting history and interests, and to measure the affectivity of those adds.
To easy access, update and export your data (where it is possible), or update your account settings, please logg inn to your Client Area and go to My Account ->Account Details.
If you ask for your data to be deleted, but the data is necessary to deliver a product or service you have bought, we will try to fulfill your request as far as it can be done.
We follow generally accepted standards for storing and protecting the personal data we collect, both while sending and storing it when it is recived, inkluding use of encryption when this is appropriate. Our Client Area have a 2-step authentication, through Google Authenticator, that we recommend our clients to use.
We keep your data only as long as it is necessary to deliver the service you have ordered. In some cases your data is kept for a period after. This can be due to:
